Terms of Use

1. Acceptance of Terms:

   By accessing our website, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use our website or services.

2. Description of Services:

   Our Squarespace template design business provides a range of pre-designed templates for use with the Squarespace platform. These templates are intended to assist individuals and businesses in creating professional, visually appealing websites efficiently.

3. Ownership and Intellectual Property:

   All templates and related materials provided by our business are the intellectual property of our company. You may not copy, distribute, modify, or resell any templates, unless explicitly permitted by us in writing.

4. Template Limited Use License:

   By purchasing a template from us, you are granted a non-exclusive, non-transferable license to use the template for a single website owned or operated by you for personal or commercial purposes. One template purchase = One license for one website. If you want to use the same template on a second website, you will need to repurchase it again to buy another license.

5. Restrictions on Use:

   You may not:

   • Reproduce, modify, or create derivative works of the template;

   • Use the template for any illegal, fraudulent, or malicious activities;

   • Remove or alter any copyright, trademark, or other proprietary notices from the template;

   • Share or distribute the template with any third parties, except as permitted under the license.

6. Copyright Terms:

   • The design is copyrighted MorningMade LLC

   • You may not resell the design or claim the design as your own.

   • You may not share the template, graphics, files or any design elements provided in your purchase with anyone else.

   • Any photography provided with the template is for demonstration purposes only and copyrighted to its original creator. You must replace these photographs with your own / source images yourself. We hold no liability for any image licensing / copyright issues that may occur through your use of any supplied images. 

7. Squarespace Template Delivery:

   We will always do our best to have your template sent within 2 business days, but this time frame may be longer due to unforeseen circumstances and we can’t guarantee that it won’t take longer. Please contact us if it has been over 48 (business) hours and you have not yet received your template.

8. Squarespace Template Ownership:

   Once the template is added into your account it is your responsibility to add your own content and edit the site. If you make any accidental changes to the template we cannot reverse these for you.

   A purchase of a Template includes your chosen template delivered only once. 

   If you make any accidental changes to your template and want the template sent again, if you accidentally delete the template, or if you don’t accept the invitation to your new template within 6 months of purchase and your free trial expires, then you will need to repurchase the template so we can send it again.

   Your template will come into your account on a 6 month free trial. If you let this free trial run out, Squarespace will mark your website for deletion. If your website gets deleted and you want the template resent, you will have to repurchase the template so we redeliver it. Make sure your trial doesn’t run out by asking Squarespace support for a trial extension, or upgrading your site to a paid plan.

9. No refunds or exchanges:

   Due to the fact that all of our products are of a digital nature, they cannot be returned or exchanged. We can't issue refunds after the purchase has been made.

10. Support Policy:

    We are happy to help you with issues relating to the template itself, the installation and build, the information provided + any problems that might arise with these. 

    Unfortunately, we don't have the capacity to help with general Squarespace related questions, template adjustments, coding adjustments or any problems that might arise from them, or any problems you are having with software.

    We offer support via email (support@itsmorningmade.com) and we aim to respond within 2 business days Monday – Friday.

11. Limited Liability:

    While we strive to provide high-quality templates, we do not guarantee their suitability for your specific needs or that they will be error-free. We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use our templates or services.

12. Indemnification:

    You agree to indemnify and hold our business, its employees, and affiliates harmless from any claim, demand, or damage, including reasonable attorneys’ fees, arising out of your use of our templates or violation of these Terms.

13. Modifications and Termination:

    We reserve the right to modify, suspend, or terminate any aspect of our services or these Terms at any time, without prior notice. If you continue to use our services after any modifications to these Terms, it constitutes your acceptance of the updated Terms.

14. Governing Law:

    These Terms shall be governed by and construed in accordance with the laws of Missouri, USA. Any legal suit, action, or proceedings arising out of these Terms shall be brought exclusively in the courts located in Missouri, USA.
